A Monterey County man allegedly raped and impregnated his 14-year-old daughter, who in turn, is being accused of killing her own daughter after giving birth. The infant was found dead on the side of a road last month.

Monterey County sheriff’s deputies are looking for the 14-year-old murder suspect. The Monterey County District Attorney’s Office, which says the teen is a victim that needs assistance, issued statements this week about the case.

On Aug. 1, fire personnel, emergency medical services and Monterey County Sheriff’s deputies responded to the 100 block of Struve Road after receiving a report that an infant had been found alongside the roadway. Upon arrival, fire personnel confirmed the infant was deceased. Sheriff’s detectives immediately began investigating the circumstances surrounding the death.

Sheriff’s detectives developed evidence indicating the teen gave birth to the baby along the side of the road and placed her on the ground before leaving the area. A post mortem forensic examination conducted on the infant indicated she had signs of a traumatic injury, according to the Monterey County Sheriff’s Office.

Detectives developed probable cause to arrest 36-year-old Ofelia Garcia Ortega, of Castroville/Salinas, on a charge of child endangerment. Ortega, the mother of the teen girl, was arrested and booked in Monterey County Jail. She later posted bail and was released from custody.

Additionally, detectives developed probable cause and obtained an arrest warrant for the 14-year-old girl for murder.

Detectives likewise developed probable cause and obtained an arrest warrant for Sergio Galvez Perez, 38, for incest, lewd or lascivious acts with a child under 14, lewd acts with a minor, unlawful sexual intercourse, child concealment and child endangerment.

Investigators determined Perez is concealing his daughter and preventing law enforcement from locating her. Sheriff’s officials are asking Perez to turn himself in.

On Wednesday, the Monterey County District Attorney’s Office release a statement saying it has not made any charging decision regarding the 14-year-old girl.

The district attorney’s office has filed criminal charges against Perez for the crime of sexually assaulting his own child. The district attorney’s office says the charge of child molestation is a serious and violent felony under California law. It constitutes a strike under California’s Three Strikes law and requires sex offender registration upon conviction.

Prosecutors are requesting a warrant be issued for Perez’s arrest, and that he turn himself in and face the charges against him.

“We recognize the 14-year-old is a victim of her father’s abuse,” the district attorney’s office said in a statement. “No child should ever have to endure such horrific circumstances.

“The responsibility for getting a child to safety does not rest on the child. Our priority is to ensure that this young girl is safe and has access to the support and services she needs. If she is located, our district attorney victim advocates and partner agencies are ready to assist her, connect her with resources, and help ensure that she has the support she needs.”

Prosecutors are reviewing potential charges against Ortega, the mother of the teen. The potential charges are unrelated to the death of the infant and unrelated to the sexual assault that Perez allegedly committed.
