Justice Anthony Kennedy denied the petition, upholding a ruling by an appeals court to allow same-sex marriages to resume in California.

Two days after the Supreme Court ruled Prop 8 unconstitutional, the Ninth Circuit Court of Appeals issued an order ending California’s ban on same-sex marriages. Same-sex couples began marrying immediately following the order on Friday.

California Attorney General Kamala Harris presided over California’s first gay wedding in four years on Friday. Prop 8 plaintiffs Kris Perry and Sandy Tier tied the knot.

On Saturday, Prop 8 supporters filed an emergency petition requesting the Supreme Court overrule the Ninth Circuit’s order.

But, the Supreme Court ruled again Sunday in favor of same-sex couples, and same-sex marriages are continuing.

Prop 8, which voters approved in 2008, overrode a California Supreme Court ruling earlier that year, which allowed same-sex couples to marry. The ballot measure created a state constitutional amendment against same-sex marriage.

In 2010, a federal court ruled Prop 8 unconstitutional, and the Supreme Court confirmed that finding last week, paving the way for same-sex marriages to resume in California.
